1. GENERAL TERMS
Between the Client
and
Noah Tours Ltd. (Registration No. 513505164) (“Noah Tours”/ “We”/ “Us”/ “Our”)

1. By signature hereof the Parties agree to be bound by the terms contained in this agreement. In the event of these Terms and Conditions not being signed by the Client, the placement of any Booking, whether through electronic mail, making an online payment, or otherwise, shall be deemed to be confirmation that the terms and Conditions of the agreement have been read and that the Client agrees to be bound by the same.

2.1 GENERAL

2.1.1.2. Room type(s) and specification;
2.1.1.3. Meals and/ or beverages included, where and if applicable;
2.1.1.4. Transfers and or transport where specified.
2.1.2. Itineraries relating to a Tour / Tour Series may be subject to change at any time
(even after issue) due to unforeseen circumstances beyond the control of Noah Tours.
This includes Travel, Accommodation and Activities.
Every effort will be made to operate itineraries as planned.

2.1.3.Noah Tours reserves the right to make alterations/Changes to and /or withdraw a Tour
/ or any part of it as is deemed necessary, and to pass on any additional expenditures or losses caused by delays or events beyond our control. In case of any variation in pricing due to these circumstances, Noah Tours reserves the right to make adjustments to the itinerary of the Tour costs as necessary.

ENROLLMENT FOR A TOUR 

To confirm a tour a prepayment enrolment fee is required as follows:

  1. A Prepayment enrollment USD $200.00 per person deposit is required by Noah Tours to confirm the tour in Israel.
  2. A Prepayment enrollment USD $300.00 per person deposit is required by Noah Tours to confirm the tour in Israel and Jordan
  3. A Prepayment enrollment USD $500.00 per person deposit is required by Noah Tours to confirm the tour in Israel, Jordan and Egypt.
  4. A Prepayment enrollment USD $1,000.00 per person deposit is required by Noah Tours to confirm the tour in Israel, Jordan and Egypt with Nile cruise.
  5. The prepayment enrolment fee is non-refundable in all cases. 
  6. To confirm the tour, all details of the participants must be filled out in the registration form.
  7. The balance payment of the tour fee is due 45 days before arrival.


    RATES
  1. Prices are per person sharing a double or twin bedroom.
  2. In the case of a single traveler, a single supplement is required.
  3. In case of human or computer error, Noah Tours reserves the right to re-invoice for the correct price or service. A full refund will be made to customers who choose not to pay an increase, provided Noah Tours receives a written cancellation within five days of the price increase notification.
  4. Prices listed on the itinerary and the website are per person unless otherwise specified.
  5. Price quotations are subject to change, the rates are valid for 7 days from the date of the offer unless otherwise specified.
  6. Unless otherwise specified, prices do not include flight tickets, visa fees, border fees, any local taxes or use fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger facility charges, or international transportation tax.

 GUARANTEED DEPARTURES 

  1. OPERATION:
    All groups are guaranteed to operate with a minimum of two (2) persons unless noted on the itinerary. Guaranteed departures will operate except only in cases of force majeure, which could include any major world event adversely affecting international travel patterns or other circumstances beyond Noah Tours' control.

  2. NOT INCLUDED IN THE PACKAGE:
    Our Guaranteed Departure Tour Packages do not include international and internal airfares unless otherwise noted; costs associated with obtaining passports or entry visas; reciprocity and other border fees; airport departure taxes, unless otherwise noted;    excess baggage charges; gratuities to the tour guides, driver-guide; meals other than those specified in the itinerary; room service,  beverages other than those noted in inclusions above or specified in the itinerary; sightseeing not included in the published itinerary; and personal expenses such as laundry, communication charges, Internet access for and optional activities (which are subject to availability). 


ITINERARIES 

  1. Noah Tours reserves the right to modify program itineraries, including arranged sightseeing and featured experts, and substitute accommodations, including vessels, and flights, at any time due to unforeseen circumstances or circumstances beyond Noah Tours' control. Reasonable efforts will be made to operate itineraries as planned, but alterations may occur after the final itinerary has been issued.

  2. Due to the nature of the itineraries are for guidance purposes only and may be adjusted due to unforeseen circumstances including but not limited to weather, mechanical and other malfunctions, medical emergencies, and other conditions beyond Noah Tours' control.

  3. OPTIONAL TOURS / ACTIVITIES
    All optional tours/activities during the tour are upon availability only and should be booked in advance. The optional tours/activities can be booked through Noah Tours only. 

TOUR PACKAGE RATES AND ARRANGEMENTS 

Quoted Rate prices are per person, double occupancy except where indicated.  Although not expected, published prices may be modified due to unexpected significant external factors not forecasted at the time of publishing. Noah Tours is under no obligation to give a breakdown of the costs of any tour. Pre- and Post-Tour Extensions are only available to guests booked on related group tours.  Any modifications to a tailor-made itinerary, including dates or number of people traveling, will require a revised proposal.  

HOTEL ACCOMMODATIONS

1. Check-in time to the hotel is from 15:00 (3:00 PM). Should you wish to have a guaranteed room ready for your immediate check-in upon arrival, it requires an additional room night to be confirmed. Please ask Noah Tours for details and prices. Requests for early check-in based on hotel availability cannot be guaranteed by Noah Tours and are at the sole discretion of the hotel.

2. Upgrades are typically available on request at individual hotels for an additional cost. Please ask Noah Tours for details and prices. Specific requests such as adjacent or connecting rooms, bedding requests, smoking rooms, and special dietary needs should be advised at the time of booking. Please note that reasonable efforts will be made to secure special requests; however, they cannot be guaranteed.

3. Hotel accommodations will be provided following the itinerary or similar. We reserve the right to make substitutions with hotels of equal standard. Noah Tours cannot guarantee a certain hotel. There will be no refunds for any difference in the cost of those accommodations.

4. All rooms are standard double queen beds or twin bedrooms unless specifically requested and paid for in an upgraded room category. Special requests such as bed types,  and connecting rooms are subject to availability. Room selection in all cases, unless otherwise reserved, is strictly at the discretion of the hotel's management.

5. Triple rooms consist of standard twin beds plus a sofa/folding bed or cot for the third person. The number of persons accommodated does not dictate the room size.

6. Hotel check-in time is generally not before 15:00 p.m. and check-out time is at 11:00 a.m. but those times may differ by each hotel. Adequate arrangements for accommodations must be taken into consideration with late-night flights.

7. Late check-out/ early check-in, is a service given upon availability – and cannot be         
guaranteed. This service may require an additional supplement.

8. Should a Kibbutz Hotel not be available, a similar hotel in the same category will be booked.

9. Dead Sea hotels are upon availability. In case of no availability, the overnight will be in 
Jerusalem.



10. Petra hotels are upon availability. In case of no availability, the overnight will be in 
Amman.

11. Noah Tours operates according to the hotels' policy. All hotel rates are based on Noah 
Tour's agreement with its suppliers and it is non-negotiable.

12. Please note that while every effort will be made to secure a special request, it cannot be guaranteed. 

TRANSFERS 

  1. The traveler’s international flight details are required to book transfers.
  2. The package cost includes transfers only on arrival and departure dates. Any additional transfers not included in the package require a supplemental payment. Transfer services for days before or after the tour may be requested before your final tour payment date. In such a case, the cost of the requested transfer service will be added to your invoice.
  3. The arrival transfer is guaranteed for up to one hour from your scheduled arrival time to compensate for minor delays. It is the traveler’s responsibility to update the company on any changes in their arrival and departure flights. In case you have arrived on a different flight without updating us, Noah Tours cannot guarantee a transfer for the new flight (the one you arrive on).
  4. In case of a delay, it is the client’s responsibility to contact Noah Tours directly or to contact the transfer company directly and/or to make other transfer arrangements such as a taxi. Transfer costs are not refundable and any additional expenses are not covered by Noah Tours. 

BORDER FEES AND VISA FEES 

  1. Border fees and visa fees must be paid by the traveler directly to the border authority at the border.
  2. Border fees are subject to sudden changes without prior notice.

TERMS BASED ON AGE 

  1. Discounts for children sharing a room as a third person apply only to children under 12 years of age.
  2. All clients making a reservation declare to be 18 years of age or older and possess the legal authority to enter into this agreement.
  3. Children under the age of 5 will not be allowed on tour except for a private tour or special accommodations made with Noah Tours.
  4. Children under the age of 2 are required to pay 50% of the tour rate. 

 

TRANSPORTATION

  1. We reserve the right to change the sequence of the tour as long as we include all the sightseeing as in the program.  
  2. Sightseeing is done in a motor vehicle, size depending on the number of participants. The size of the vehicle is at the sole discretion of the company.
  3. The number of participants may vary during the tour, as Noah Tours accommodates travelers arriving from different airlines and on different days of the week.
  4. Noah Tours cannot guarantee the number of passengers who will be on any given tour. However, rest assured that services will remain constant no matter the number of tour participants.
  5. Times listed online in itineraries are approximate and are only guidelines. Itineraries listed online are approximate and meant as guidelines only.
  6. Tours are conducted in various sizes of tourism buses, cars, and vehicles. Change of vehicle required for transfers of pick up/drop off to save time.
  7. Noah Tours makes all efforts to provide Wi-Fi of the best quality in all of the motor coaches nevertheless Noah Tours takes no responsibility in case Wi-Fi service is not provided.
     

DELAY POLICY

  1. ARRIVING LATE to any service, including a day of sightseeing, may be considered a "no-show", and in such case, there will be no refund for the unused service(s). Arriving late without notice (24 hours) due to a force major, such as weather, security situation, etc. will also not be refunded.
  2. In case of any delay of arrival, it is the client’s responsibility to contact Noah Tours directly or to contact the transfer company directly and/or to make other transfer arrangements such as a taxi. Transfer costs are not refundable and any additional expenses are not covered by Noah Tours.

SIGHTSEEING

  1. Noah Tours reserves the right to make any itinerary changes deemed necessary. In cases where a program is changed, a sight removed will be substituted with an alternative visit, or we may choose to remove a sight to allow for more time at other listed locations. In such an event Noah Tours will not offer participants a monetary refund or compensation of any kind.
  2. Events, Attractions, Coupons, Museums, Shows, or Flight tickets are non-refundable.
  3. Noah Tours does not book any international flights (unless specifically mentioned otherwise).
  4. Noah Tours reserves the right to implement alternative locations other than the itinerary due to force majeure (such as weather conditions, security limitations, etc.). 
  5. Noah Tours reserves the right to cancel tours due to circumstances beyond our control.
  6. On dates including, but not limited to, religious holidays and national celebrations, some monuments and sites may be closed. In such cases, tour itineraries may be amended to reflect these changes and compensate for them by visiting other sites.
  7. All tours are available in English. Tours conducted in other languages will be given by request and only if there is availability and confirmation from Noah Tours.
  8. All Noah’s Tours guides are government-licensed tour guides.
  9. Noah Tours may operate this tour with other tour operators and agents. 
  10. Noah Tours reserves the right to change and/or add a guide during the tour.
  11. In group tours – entrance to the Holy Sepulcher depends on the queue and time available.  The entrance to the Church is not guaranteed.
     

LUGGAGE 

  1. All tour packages allow one piece of luggage per person and one carry-on bag. Excess luggage will be subject to a charge of up to USD $100.00 per piece. 
  2. Noah Tours shall not be held responsible for any damage to or loss of luggage/personal items.
  3. All damage/loss must be reported at the time of the incident and documented in writing by local authorities for submission to the insurance company.
     

 MEALS ON TOUR 

  1. Meals on tour are as specified in the itinerary. Meals are based on the hotel's or restaurant's set menu or buffet. Beverages are excluded unless specified.
  2. Noah Tours packages include breakfast only.
  3. The dinner Package is optional and requires a supplement. The number of dinners is applied as mentioned in the itinerary.
     

CODE OF CONDUCT 

  1. Please be polite and courteous to all members of the group as well as all staff members to avoid issues. Noah Tours reserves the right to remove any participant from the trip, at the participant's own expense, for any conduct that negatively impacts the enjoyment of the other guests or disrupts the tour. It is at Noah Tours' discretion to decide if a participant is negatively impacting the other guests and tours and said participant can be dismissed from the tour at any time with no refund. 
  2. Please stay with the guide at all times and do not wander away unless explicitly given free time to explore by the guide. 
  3. When the guide is speaking, please be attentive and do not talk amongst yourselves as it distracts the guide and other group members. 
  4. Failure to comply with any of the above can result in immediate dismissal from the tour with no refund to the participant. 
     

PAYMENT

  1. BANK TRANSFER 

    Payment is done via bank transfer: a bank transfer fee of USD 50.00 will be added to the tour cost.     

    All bank transfer fees must be paid by the sender.

    When the customer does not pay a transfer fee, it will be added to the tour fee.

      2. CREDIT CARDS AND PAYPAL

         Noah Tours accepts Visa, MasterCard, and American Express. Credit card charges     
         will only be processed upon submission of a completed Noah Tours credit card form.
       
        A credit card fee should be added to the total tour fee when paying the tour as
        follows: 
       
        Visa and MasterCard – a  0% credit card fee should be added to the total tour
        fee;
        American Express – a 2.6% should be added to the total tour fee. PayPal - 4% should
        be added to the total tour fee.

VISAS AND IMPORTANT DOCUMENTS

  1. Travelers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required.
  2. Noah Tours does not accept any liability for travelers who are refused entry onto a flight or into any country because the traveler failed to carry or present any travel documents required by the airline, authority, or countries (including countries the traveler passes through en route to their destination.
  3. Travelers are responsible for ensuring that their passports are valid for at least 7 months before the start of their flight.
     

TRAVELLERS WITH DISABILITIES

  1. Noah Tours will make all reasonable accommodations to meet the needs of our disabled tour participants. Tour participants requiring any form of assistance or special accommodations are required to notify Noah Tours in writing at the time of reservation and Noah Tours will use its best efforts to accommodate the tour participant’s needs.
  2. Tour participants requiring assistance on a regular or routine basis must be accompanied by an individual responsible for providing those services. Tour managers, guides, drivers, or another tour, or hotel, are not required to assist as it makes it impossible for them to fulfill their regular and required obligations.
  3. Due to space limitations, special advance arrangements may need to be made to accommodate wheelchairs and walkers aboard motor coaches.
  4. In case you add a wheelchair to the service.  There is no refund for this even if you do not end up using the wheelchair.
     

MEDICAL COVERAGE

  1. Clients are urged to acquire travel & medical insurance before arrival. Noah Tours will not be held responsible for any injury, loss, damage, accidents, or delays which may occur.
  2. The Covid-19 test expenses need to be covered by the client.
     

CANCELLATION POLICY 

During the Regular Season  (excluding July, August, Jewish, and Christian holidays): 

1. 
The prepayment enrolment fee is non-refundable in all cases.

2. Cancellation before your arrival date. This cancelation must be submitted in writing via email.

3. A cancelation was given 45 days - 31 day  prior to the tour: 25% cancellation fee of the total price plus the prepayment, which is non-refundable. 30 Business or less days before the tour or no show: no refund will be given  (100% cancellation fee)

During the High season (July, August, Jewish, and Christian holidays):

  1. Cancelation prior to your arrival date. This cancelation must be submitted in writing via email.
  2. The Prepayment in all cases is non-refundable.  
  3. Cancelation given 91 days - 61 days prior to the tour: 75% of the total price is refunded, excluding prepayment (25% cancellation fee).
  4. Cancelation has been given 60-day - 31-day prior to the tour: 50% of the total price is refunded, excluding prepayment (50% cancellation fee).
  5. Thirty (30)  days or less prior to the tour or no show: no refund will be given  (100% cancellation fee).

FLIGHTS

  1. Domestic, Regional, and International Airfare is excluded from the cancellation policy and will not be refunded once purchased.
  2. Participants may choose not to tour with the group on 1 or more days; no refund shall be given for untaken tour days as this is breaking the package.
     

PRIVACY POLICY

  1. Noah Tours reserves the right to take photographs and videos during the tour and to use them for promotional purposes during the tour and thereafter. By booking a tour with Noah Tours, guests agree to allow their images to be used unless they request in writing otherwise by emailing to this address: sales@noahtours.com.
  2. Any false or fraudulent reservation is prohibited.
  3. Our performance of this agreement is subject to existing laws and legal processes in Israel, and nothing contained in this agreement limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of this website or information provided to or gathered by us with respect to such use. To the extent allowed by applicable law, you agree that you will bring any claim or cause of action arising from or relating to your access or use of this website within two (2) years from the date on which such claim or action arose or accrued or such claim or cause of action will be irrevocably waived.
  4. There is an option to publish a public review on our site. Noah Tours Ltd. will publish the following details regarding your personal information on our site: full name, date of review, the review, and the translation of the review. All published reviews are available to any person accessing the site. Noah Tours reserves the right not to publish a review.
  5. You may unsubscribe at any time by sending an email to sales@noahtours.com with your reference number – asking to unsubscribe. 
     

INSURANCE & LIABILITY

  1. Travel insurance is a vital part of your arrangements. We strongly recommend that all passengers are adequately insured before traveling abroad, for the whole duration of their journey. In any event, we strongly advise that you take out a policy of insurance in order to cover you and your party against the cost of cancellation; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses.

  2. Noah Tours acts as a direct or indirect agent between the passengers participating in the flight and/or tour, and/or the travel agent who organizes the flight or tour, and between the airlines, hotels, restaurants, railway companies, bus companies, their owners, managers, and employees or their representatives, and is not to be held responsible in any mishap of the services connected and/or rendered by the aforementioned companies and/or persons. All participants in these tours are bound by the general conditions, rules, and regulations as fixed by the contractors. Any damage and/ or injury, loss, and/or additional expenses caused by a reason beyond the control of Noah Tours or not under their direct control, will be borne by the participants and on their sole responsibility. Noah Tours Ltd. reserves the right to change any tour, or part of it, postpone it, or alter dates and hours of departures. Noah Tours Ltd. advises all participants to insure themselves and their belongings.

  3. Once the tours are across the border, the Egyptian/Jordanian tour company takes full responsibility for the tour.

  4. Noah Tours will not accept responsibility for any loss, injury, or damage.

  5. Any legal steps you are considering against members and or other parties should not include Noah Tours Ltd. Those legal steps can include seeking a legal remedy from Noah Tours, imposing harm on Noah Tours, or any other legal activity.

  6. Those who choose to access the website from outside of the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable.

  7. The information, content, software, products, and services published on this website may include inaccuracies or errors, including reservation availability and pricing errors. Noah Tours does not guarantee the accuracy of and disclaims all liability for, any errors or other inaccuracies relating to the information and description of the products and services displayed on this website (including, without limitation, the pricing, availability, photographs, features, inclusions and exclusions, general product descriptions, reviews, and ratings, etc.). In addition, Noah Tours expressly reserves the right to correct any availability and pricing errors on our website and/or on pending reservations made under an incorrect price.

  8. Suppose Noah Tours is found liable for any loss or damage that arises out of or is in any way connected with your use of our websites, itineraries or your booking or use of products or services made available through Noah Tours. In that case, Noah Tours liabilities will in no event exceed, in the aggregate, the greater of:

    a) The transaction fees paid to Noah Tours for the transaction(s) giving rise to the claim 
    OR
    b) One-Hundred Dollars (USD $100.00)

YOUR LIABILITY 

  1. You agree to defend and indemnify Noah Tours and the Noah Tours' respective officers, directors, employees, and agents from and against any claims, causes of action, demands, suits, proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs and any other liabilities of any kind or nature including but not limited to reasonable legal and accounting fees, arising out of or related to:

        a) Your breach of this agreement or the documents referenced herein;
        b) Your violation of any law, rule, regulation, or guideline;
        c) Your violation, infringement, or misappropriation of the rights of a third party, 
              including without limitation any rights of publicity or privacy;
        d) Your use of this website;
        e) Your booking or use of any products obtained through this website;
         f) Your negligence or willful misconduct.
 

DRESS CODE, HARMONY, AND BEHAVIOR  

  1. Noah Tours may require that a passenger withdraw from the tour if we deem their conduct to be offensive or to cause annoyance to other passengers. Noah Tours has no further liability for the carriage of such passengers.
  2. For all tours except Masada and The Dead Sea, modest attire is required for visiting holy places of any religion (men with head covering, women with shoulder covering, for both men and women - no shorts).
  3. You agree that all claims you may have against Noah Tours Ltd. must be heard and resolved in a court of competent subject matter jurisdiction located in Israel.
  4. You agree that no joint venture, agency, partnership, or employment relationship exists between you and Noah Tours and affiliates due to this agreement or use of this website.
  5. Partial Room Cancellation: If a guest cancels or leaves a journey and a roommate remains, an additional supplement may apply to the price for the remaining guest.
  6. During the tour, customers are required to stay with their group and the guide. Separation from the group can result in being left behind & will be at the customers' expense. No refund shall be given in this instance.
     

FEEDBACK

We welcome and encourage you to provide feedback, comments, and suggestions for improvements to our service. You may submit Feedback by emailing us at sales@noahtours.com. You acknowledge and agree that all feedback will be the sole and exclusive property of Noah Tours and you with this irrevocably assign to Noah Tours and agree to irrevocably assign to Noah Tours all of your rights, title, and interest in and to all feedback, including without limitation all worldwide patent, copyright, trade secret, moral and other proprietary or intellectual property rights therein.
 

LITIGATION AND DISPUTE RESOLUTION

In case of any litigation dispute, the resolution of the matter between the parties will be held in an Israeli court of law only.

PAYMENT OF THE TOUR PRICE CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN.
